What is a workplace investigation?
Allegations of bullying, sexual harassment or other serious employee misconduct need to be dealt with promptly and efficiently. A failure to take appropriate action may expose the employer to prosecution, or to a court action for damages. A workplace investigation is an enquiry into those allegations. It may be conducted internally or by an external, independent investigator.
When will there be a workplace investigation?
Many disputes in the workplace are not serious. There may be less formal ways of dealing with the parties involved, including mediation, staff reviews, or training. More serious matters should be referred to an investigation. These may include allegations of bullying, sexual harassment, discrimination, inappropriate use of social media or unlawful conduct.
What is investigation process?
The investigator will interview the people involved, and will look for any other relevant evidence including documentary or digital evidence. A report will then be prepared for management. That report will set out the findings of the investigator.
How are interviews conducted?
The investigation is a confidential process. All of the parties interviewed will be required to maintain that confidentiality. Participants will be given information about the allegations and the investigation process. They may choose to have an appropriate support person at the interview.
The report
After reviewing all of the evidence, the investigator will prepare a report for management. This will include the allegations and a summary of the evidence. It will usually also refer to relevant legislation and the policies of the organisation. The report will set out findings of fact and the conclusions of the investigator.
