What is mediation

Conflict between people occurs in all areas of life. It can be harmful and disruptive to the people involved in the dispute. It can adversely affect families, organisations and workplaces.

Mediation is a process where people in conflict are brought together before an independent and skilled person with a view to identifying the issues in dispute, and finding ways to resolve that dispute.

What happens at a mediation?

The mediator is appointed by the parties, or by another person or organisation. The mediator will usually meet separately with each of the parties to confidentially discuss the issues. There will then be a formal meeting in which each of the parties, and the mediator, discuss those issues and seek to find ways to settle the dispute.

Parties may be assisted by an appropriate support person. This may be by a friend, a family member or a fellow employee.

The mediator controls the discussions and ensures that it is conducted in a fair and respectful manner. The process is confidential and the matters discussed cannot be revealed to persons outside the mediation unless the parties consent.

What are the advantages of mediation?

Mediation is time saving and cost effective. It gives the parties the opportunity to control the outcome.

Mediation in the workplace

Disputes in the workplace can adversely affect staff morale and productivity. Most larger organisations now have compulsory policies and procedures dealing with workplace disputes. These usually require mediation as part of the process. There are similar requirements in many awards and EBAs.

Why choose an external mediator

It is important that the mediation process be seen to free of any perception of bias. An external mediator is neutral and not aligned with either side in the dispute. This is particularly important where the dispute is between management and staff, or between senior employees.
